These Terms & Conditions govern use of the DeckQ™ and InciCap™ reporting systems, operated by PPEPlus Ltd. By accessing or using either system, you agree to these Terms.

1. The Services

DeckQ™ and InciCap™ are digital reporting systems designed to support the recording of safety-related and incident information.

• DeckQ™ provides location-anchored workplace reporting.

• InciCap™ provides vehicle-anchored incident reporting.

Reports submitted through either system are time-stamped and converted into digital records, including PDF outputs. The services provide recording and documentation infrastructure only.

2. What the Services Do Not Do

DeckQ™ and InciCap™ do not:

• Determine fault, liability, or causation

• Assess compliance with legislation or guidance

• Replace investigations, risk assessments, or statutory duties

• Provide legal, regulatory, insurance, or professional advice

• Act as an enforcing authority, regulator, or insurer

Use of the services does not guarantee legal or regulatory compliance.

3. User Responsibilities

Organisations and users are responsible for:

• Ensuring information submitted is accurate and complete

• Acting appropriately on reports received

• Carrying out any required investigations or follow-up actions

• Complying with applicable health, safety, transport, and employment law

PPEPlus Ltd does not verify or validate the accuracy of submitted information.

4. Access & Availability

PPEPlus Ltd will take reasonable steps to maintain service availability but does not guarantee uninterrupted access.

Temporary suspension may occur for maintenance, updates, or technical reasons.

5. Intellectual Property

All intellectual property relating to:

• DeckQ™

• InciCap™

• PPEPlus™ / PPE+™

• System architecture, workflows, designs, and outputs

is owned by the original creator and licensed to PPEPlus Ltd for commercial operation.

Users may not copy, modify, resell, or misrepresent the systems or associated materials without written permission.

6. Data & Reports

Reports generated through DeckQ™ or InciCap™:

• Reflect information submitted by users

• Are provided as factual records only

• Do not constitute conclusions, findings, or opinions

Responsibility for use, interpretation, and onward sharing of reports rests with the organisation using the service.

7. Limitation of Liability

To the maximum extent permitted by law:

• PPEPlus Ltd is not liable for indirect or consequential loss

• PPEPlus Ltd is not responsible for decisions made based on submitted reports

• Liability is limited to losses arising directly from use of the service

Nothing in these Terms limits liability where it cannot be excluded under Scots law.

8. Changes to the Services or Terms

PPEPlus Ltd may update the services or these Terms from time to time.

Continued use of DeckQ™ or InciCap™ constitutes acceptance of any updated Terms.

9. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Scotland.

Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
